Terms of Use
These Terms of Use ("Terms") set forth the conditions for using the
"World Heritage Walking" application (the "Service") provided by Shohei
Nakagawa ("we", "us"). Please read these Terms carefully and agree to
them before using the Service.
Definitions

"Service": The smartphone app and any related services that we
operate.
- "Service Store": App Store and Google Play.
- "User": Any person who uses the Service.

"Personal Information": Information that can identify an individual
such as address, name, occupation, and phone number.

"Registration Information": Information registered by a user within
the Service.
Consent to the Terms
Users may use the Service only after agreeing to these Terms. When a
user downloads the Service to a smartphone or other device and completes
the consent procedure for these Terms, a usage agreement governed by
these Terms is deemed to have been concluded between the user and us.
If a user is a minor, the user must obtain the consent of a parent or
other legal guardian before using the Service. If a minor user uses the
Service while falsely claiming to have such consent or to be of legal
age, or uses any other deceptive means to make us believe the user has
the capacity to act, the user may not rescind any legal acts related to
the Service. If a user who was a minor at the time of agreeing to these
Terms uses the Service after reaching the age of majority, the user is
deemed to have ratified all legal acts related to the Service.
Changes to the Terms
We may revise these Terms at any time without obtaining user consent,
and users agree to such revisions without objection. When we revise
these Terms, we will notify users of the revised content in a method
prescribed by us. The revisions take effect when such notice is made. If
a user uses the Service after the revisions, the user is deemed to have
agreed to the revised Terms.
Account Management
Users shall register and manage information provided during use of the
Service ("Registration Information", including social accounts, email
addresses, IDs, and passwords) at their own responsibility. Users shall
not allow third parties to use, lend, transfer, change the name of, or
sell such information. If the Service is used with Registration
Information, we may treat such use as by the registrant, and any results
and all responsibilities arising therefrom belong to the registrant. If
improper use of Registration Information causes damage to us or a third
party, the user shall compensate for such damage. We bear no
responsibility for any disadvantage or damage suffered by users due to
inaccurate or false Registration Information. If theft or unauthorized
use of Registration Information is discovered, the user shall promptly
notify us and follow our instructions.
Personal Information
We handle personal information obtained in connection with providing the
Service in accordance with our Privacy Policy.
Prohibited Acts

Infringing the intellectual property rights of us or third parties

Damaging the reputation or credibility of us or third parties, or
unjustly discriminating against or defaming them

Infringing (or likely to infringe) the property of us or third parties
- Causing economic damage to us or third parties
- Threatening us or third parties

Reproducing, modifying, or altering content (information, software,
photos, images, messages, etc.) on the Service without permission
- Placing excessive load on the infrastructure for the Service
- Using or inducing computer viruses or other harmful programs

Reverse engineering, decompiling, disassembling, or otherwise
analyzing part or all of the Service
- Any other acts we deem inappropriate
Disclaimer

We are not liable for any damages arising from changes to,
interruption of, or termination of the Service.

We are not involved in and bear no responsibility for users'
environments for using the Service.

We make no warranties that the Service will fit users' particular
purposes, have expected functions, commercial value, accuracy, or
usefulness, comply with laws or industry rules applicable to users, or
be free from defects.

We do not warrant that the Service supports all devices. Users
acknowledge that OS updates of devices used for the Service may cause
malfunctions. We do not warrant that our fixes will resolve any such
malfunctions.

Users acknowledge that changes to the Service Stores' terms or
operational policies may restrict use of part or all of the Service.

We bear no liability for any direct or indirect damages suffered by
users arising from use of the Service.

Even if we were notified in advance of the possibility of damages, we
bear no responsibility for any damages suffered by users or third
parties, including lost opportunities, business interruption, or any
other damages (including indirect or consequential damages, or lost
profits).

The above does not apply where we act willfully or with gross
negligence, or where the user is a "consumer" under the Consumer
Contract Act of Japan.

Even where the preceding item applies, we shall not be liable for any
special damages arising from special circumstances among the damages
caused to the user by our negligent acts (excluding gross negligence).

We bear no responsibility for disputes or troubles between users. Any
disputes between users shall be resolved between them, and no claims
shall be made against us.

If, in connection with a user's acts, a third party makes a claim for
damages against us, the user shall resolve such claim at the user's
expense (including attorney's fees) and responsibility. If we pay
damages to such third party, the user shall reimburse us for all
expenses, including such damages (including attorney's fees and lost
profits).

If a user causes damage to us in connection with use of the Service,
the user shall compensate us for such damage (including litigation and
attorney's fees) at the user's expense and responsibility.
In‑App Services
(1) Ads
Users understand and agree that ads may be included in the Service and
that we or our partners may display various ads. The form and scope of
ads on the Service are subject to change from time to time at our
discretion.
(2) Donations via In‑App Purchases
The Service is free to use, and users may make donations to the
developer via in‑app purchases. See the dedicated in‑app page for
details. Please note that donations are non‑refundable.
(3) Subscriptions

Some features are provided via in‑app purchases
(subscriptions/one‑time purchases).

Pricing, duration, and conditions follow what is displayed in‑app or
on each store.

Subscriptions renew automatically. Unless auto‑renew is turned off at
least 24 hours before the end of the current period, your subscription
will renew and your account will be charged within the 24 hours prior
to the end of the current period. Cancellation/changes can be managed
in the respective app store account settings.

Ownership of Rights

Copyrights and other intellectual property rights in data posted by
users to the Service ("Posted Data") belong to the users; we do not
acquire such rights. However, by using the Service, users grant us a
free, perpetual, worldwide license to use Posted Data, including the
rights of reproduction, public transmission, communication to the
public, narration, transfer, lending, translation, and adaptation.

Users agree not to exercise moral rights in connection with the Posted
Data.

Data in the Service other than Posted Data belongs to us or third
parties who have licensed such rights to us. Users may not assign all
or part of their status or rights and obligations under these Terms to
any third party without our prior written consent.
Contact
Inquiries regarding the Service shall be made via the Service Store or
by a method separately designated by us.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the
laws of Japan. Any disputes, lawsuits, or other controversies between us
and users shall be subject to the exclusive agreed jurisdiction of the
Osaka Summary Court or the Osaka District Court depending on the amount
in controversy.
